EF Elite Sales – Terms & Conditions

General Information

1. Alberta Ltd. 1852306, operating as EF Elite Sales (“EF Elite Sales”), acts as an intermediary between buyers and sellers in connection with the EF Elite Sale – Summer Edition.
2. EF Elite Sales is conducted as a hybrid auction sale. To actively bid, bidders must register either online prior to the sale or in person on Thursday, June 11, 2026. Veterinary documentation is available exclusively through the online platform. All veterinary information and documentation are posted on each horse’s individual sale page. 3. Pre-purchase examination (“PPE”) information, including radiographs/x-rays where provided, is available on each horse’s sale page. Buyers are solely responsible for conducting their own due diligence, including obtaining independent veterinary review and advice prior to bidding. All information provided regarding the horses is supplied by the seller and is believed to be accurate; however, EF Elite Sales makes no representations or warranties regarding the accuracy or completeness of such information. Any claim, dispute, or right of recourse relating to the horse must be directed solely to the seller and not to EF Elite Sales, its owners, employees, agents, or representatives.
4. Purchased horses may remain boarded free of charge for up to ten (10) days following the closing date of the auction. After June 21, 2026, any additional boarding arrangements and expenses shall be the sole responsibility of the buyer unless otherwise agreed in writing.
5. If requested, EF Elite Sales and/or the seller will make reasonable efforts to assist buyers in arranging transportation, boarding, and cross-border health documentation. However, all associated costs, risks, and final arrangements remain the responsibility of the buyer.

Sale & Auction Terms

1. Each horse shall be sold to the highest bidder as determined by the auction platform and/or auctioneer. EF Elite Sales reserves the right to reject or refuse any bid, bidder registration, or participation at its sole discretion.
2. All horses are sold “AS IS, WHERE IS,” with no guarantees, warranties, or representations, express or implied, including but not limited to fitness for a particular purpose, soundness, merchantability, or future performance. Sellers listed in the catalog are represented as the legal owners of the horses offered for sale and warrant that the horses are free and clear of liens and encumbrances unless otherwise disclosed.
3. Each horse will be insured for a period of ten (10) days following the closing date of the auction at no additional cost to the buyer. Buyers seeking extended or additional insurance coverage may arrange coverage independently, including through BFL Canada (see contact information provided).
4. The auction is a hybrid auction, with online bidding opening June 10, 2026, followed by the live sale on June 11, 2026.
5. Horses will sell according to their assigned lot numbers. The auctioneer shall have sole discretion in determining the successful bidder and the final sale of each horse.
6. Online bidding will be available through the EF Elite Sales online platform. Bidders acknowledge that online bidding may experience delays of up to five (5) seconds or more and bid accordingly. EF Elite Sales shall not be responsible for technical difficulties, internet interruptions, or missed bids.
7. EF Elite Sales is a reserve auction. Sellers reserve the right to establish minimum sale prices.
8. Risk, responsibility, and ownership of the horse shall transfer to the buyer immediately upon the horse being declared sold by the auctioneer, notwithstanding that the horse may remain boarded with the seller following the sale.

Terms of Payment & Settlement

1. All sales are final. Payment in full must be received within forty-eight (48) hours of receipt of invoice. Accepted payment methods include e-transfer, wire transfer, or credit card. Credit card payments are subject to a 3.5% administration fee.
2. A buyer’s premium of 5% shall be added to the final purchase price unless otherwise stated.
3. GST shall be charged where applicable in accordance with Canadian law.
4. If payment is not received within the required timeframe, EF Elite Sales reserves the right to cancel the sale, retain any deposits, and/or pursue any legal remedies available.
5. These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein.
